Welcome to USEDATA. These Terms of Service (“Terms”) govern your access to and use of the website located at https://www.usedata.co/ and the associated data visualization services (the “Service”).

1. Description of Service

USEDATA provides an AI-powered platform that processes user-uploaded data (such as POS exports) to generate visualizations and business insights through AI agents (“SalesOps Agent” and “Data Viz Agent”).

2. User Accounts

• Eligibility: You must be at least 18 years old or the age of majority in your jurisdiction.
• Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Data Ownership and License

• Your Data:You retain all ownership rights to the raw data you upload to the Service (“User Data”).
• License to USEDATA: By uploading User Data, you grant USEDATA a world-wide, non-exclusive, royalty-free license to process, host, and analyze your data solely for the purpose of providing the Service to you.
• AI Outputs:You own the visualizations and reports generated specifically for your data, subject to USEDATA's ownership of the underlying AI models and platform.

4. Acceptable Use

You agree not to:

• Upload data that contains malware, viruses, or illegal content.
• Attempt to reverse-engineer the AI agents or the platform's source code.
• Use the Service to process Protected Health Information (PHI) or highly sensitive personal data without prior written consent.
• Exceed the limits of your subscription tier (e.g., prompt limits or data storage caps).

5. Fees and Payments

• Free Tier: Limited to 1 Workspace and 5MB of data. USEDATA reserves the right to modify these limits.
• Paid Subscriptions: Fees are billed in advance on a recurring basis. All fees are non-refundable unless required by law.
• Cancellations: You may cancel your subscription at any time; however, you will retain access until the end of the current billing cycle.

6. Limitation of Liability

USEDATA provides insights based on AI interpretation of your data. We do not guarantee 100% accuracy. USEDATA shall not be liable for business decisions made based on the Service's outputs. In no event shall USEDATA's liability exceed the amount paid by you in the 12 months preceding the claim.

7. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or if your use of the Service poses a security risk to other users.
